In China, nearly 900 copyright conflicts take place every day.

In 2021, the number of copyright conflicts increased by around 45.34% compared to 2020.
PART II. REGIONAL DISTRIBUTION OF COPYRIGHT CONFLICTS (HIGH LOW)
No.1 Guangdong Province
In 2023, Guangdong registered over 260,000 software copyrights.
No.2  Hebei Province
No.3  Shandong Province
Shandong has completed 873,826 copyright registrations, accounting for 13.59% of the national total in 2023.

IS THE HIGH INCIDENCE OF COPYRIGHT CONFLICTS A RESULT OF HIGH CREATIVITY?





ANSWER: NO





I analysis the data of Top 3 provinces (city) in terms of copyright works and compared their infringement case numbers. 


I found that, despite Beijing's outstanding performance in creation, it has a relatively low number of infringement cases.

Copyright conflicts are more prevalent in regions with high creativity but low economic development, where there is a lack of copyright laws and regulations.
PART III. WHAT WERE THE OUTCOMES OF THE CASE TRIALS?











Supported vs. Withdrawn
In nationwide first-instance copyright ownership disputes, only about 13% of plaintiffs' claims are supported, while more than half of the cases are withdrawn.
PART IV. WHY WERE HALF OF COPYRIGHT DISPUTE CASES WITHDRAWN?

Out-of-Court Settlement
When faced with compensation and confidentiality clauses, some infringed creators choose to settle to avoid prolonged litigation.
Power Imbalance      
For the side with capital, distorting the facts is not difficult.
High Litigation Costs      
51.93% of copyright conflicts take 1~3 months to process, with some cases lasting over a year, resulting in significant time and financial costs.
   How frail the infringed creator is when confronted with the power of capitalists...
